Terms and conditions

Article 1 – Subject

These conditions govern sales by Le Château de Taillan on this site.

Article 2 – Prices

The prices of the products are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs.

In case of order to a country other than metropolitan France you are the importer of the product or products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Le Château de Taillan. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to ask your local authorities about these aspects.

All orders regardless of origin are payable in € (euros).

Le Château de Taillan reserves the right to change its prices at any time, but the product will be invoiced on the basis of the actual price at the time of the validation of the order and subject to availability.

The products remain the property of Le Château de Taillan until full payment of the price.

Attention: as soon as you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.

Article 3 – Orders

The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.

The Castle of Taillan reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problem, or in case of difficulty concerning the order received.

Article 4 – Confirmation of your order

Article 5 – Payment

The payment of your purchases is done by bank card thanks to Crédit Agricole’s secure “Up2pay e-Transactions” system.

Article 6 – Cancellation

In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from receipt of your products to exercise your right to withdraw without having to justify or pay a penalty.

Returns are to be made in their original condition and complete (packaging, accessories, instructions). In this context, your liability is incurred. Any damage suffered by the product on this occasion may be liable to defeat the right of withdrawal.

Return costs remain at your expense.

In case of exercise of the right of withdrawal, Le Château du Taillan will refund the sums paid within 14 days of notification of your request.

EXCEPTIONS TO THE RIGHT OF RETRACTION
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:

The provision of services fully performed before the end of the withdrawal period and the performance of which has begun after prior express consent of the consumer and express waiver of his right of withdrawal.
The supply of goods or services the price of which depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period.
The supply of goods manufactured according to consumer specifications or clearly customized.
The provision of goods that may deteriorate.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The supply of goods which, having been delivered and by their nature, are inseparably mixed with other articles.
Transactions concluded in a public auction.

Article 7 – Availability

Our products are offered as long as they are visible on the chateaudutaillan.com website and within the limits of available stocks.

In case of unavailability of product after placing your order, we will inform you by email. Your order will be automatically cancelled and a refund will be issued.

Article 8 – Delivery

The products are delivered to the delivery address indicated during the order process, within a maximum of 10 days.

In case of a delay in shipping, an email will be sent to inform you of a possible consequence on the delivery time indicated to you.

In accordance with the legal provisions, in case of delivery delay, you benefit from the possibility to cancel the order under the conditions and modalities defined in article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund it and pay the shipping costs in accordance with the conditions of article L 138-3 of the French Consumer Code.

In case of delivery by a carrier, Le Château du Taillan cannot be held responsible for late delivery due exclusively to unavailability of the customer after several offers of appointments.

In case of delivery to the relay point, the customer undertakes to pick up the parcel within 15 days. Any unclaimed parcel after 15 days in relay point will not be refunded.

Article 9 – Warranty

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it can be returned, exchanged or refunded.

All complaints, exchange or refund requests must be made by email to info@chateaudutaillan.com within 30 days of delivery.

The products must be returned to us in the state in which you received them. The shipping costs will be refunded on the basis of the charged rate and the return costs will be refunded on presentation of the vouchers.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 – Responsibility

The products offered comply with the French legislation in force. The responsibility of Le Château du Taillan cannot be incurred in case of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities on the possibilities of importing or using the products or services you intend to order.

Furthermore, Le Château de Taillan cannot be held responsible for damages resulting from the misuse of the purchased product.

Lastly, Le Château de Taillan cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including a breakdown of service, external intrusion or the presence of computer viruses.

Article 11 – Law applicable in the event of disputes

The official language of this contract is French. These Terms of Sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

Article 12 – Intellectual property
